You have the right to ask for a Medicaid Fair Hearing. You can do this at any time by calling the New York State Office of Temporary and Disability Assistance at:

You, your doctor, or someone else, with your written approval, may call or write to ask for a hearing. You must request this hearing in (60) days or less from the first decision.

You will receive a letter from the hearing officer. The letter will tell you the date and time of the hearing. The letter tells you how to get ready for the hearing. You may have the meeting by phone or in person. You have the chance to explain why you asked for the service. The hearing office will review the case and make a decision. The Fair Hearing officer will give you a final decision.
